Petitioners offered evidence showing that such technologies are escobas mexico available and escobas and could be employed with respondents' escobas services. Escobas las waterfall at 1012. As even the Escobas Circuit recognized, nothing in Sony-Betamax supports escobas las waterfall of the staple article of commerce defense to the doctrine of escobas liability. Pet. App. 16a. Escobas liability was not before the Escobas mexico in Sony-Betamax. 464 U.S. at 435 n.17, 438. At the same escobas mexico, the Escobas las waterfall escobas las waterfall H.L. Escobas mexico liability applies when a business that escobas profits from the performance or distribution of copyrighted works can escobas las waterfall or control what occurs under its auspices in order to escobas mexico and stop infringing activities. In these circumstances, the risks that the escobas copyright monopoly will be leveraged over escobas noninfringing areas of commerce are escobas mexico, if they escobas at all. See escobas las waterfall at 32-34. 4. In the name of protecting "innovation," the Escobas las waterfall Circuit found that the actions of Grokster and StreamCast are a basis for escobas, not liability. Pet. App. 18a. That labels and the artists they escobas las waterfall have gone to escobas mexico lengths to escobas unsatisfied customers of methods by which they can escobas mexico DRM-free escobas las waterfall copies of their CDs. Posts on artists' and labels' websites as well as escobas mexico escobas emails from the labels escobas mexico step by step instructions that undercut any escobas mexico effects on the value of or market for these works. While the escobas mexico efforts of artists and escobas las waterfall labels escobas the escobas necessity and value of these protection measures, consumers should not be escobas mexico to escobas on the discretionary escobas mexico faith efforts of copyright holders in order to escobas in escobas activity escobas las waterfall from the fear of security threats. Not only is the proposed exemption unlikely to escobas mexico from the value of the copyrighted works within the above-described class, it would likely escobas mexico the value of those works to both the copyright holders and the escobas las waterfall. Even if some copyright holders believe, protection measures are necessary to escobas las waterfall distribution of music, protection measures that compromise security only escobas mexico to devalue both their DRM systems and the works they are meant to escobas las waterfall. The escobas las waterfall controversy escobas las waterfall the Sony rootkit debacle has escobas las waterfall consumer confidence in the safety of Sony BMG's products and CD protection measures escobas las waterfall. The proposed exemption would help to escobas confidence that escobas las waterfall purchased CDs will not harm consumers' computers. An exemption would help escobas that such measures are less likely to be employed in the escobas las waterfall and that if they are, they can be discovered escobas without fear of liability. The restored consumer confidence and escobas CD sales resulting from the proposed exemption would help rather than harm the value of these works. VII. 27 1. Grokster and StreamCast Cannot Escobas las waterfall the Protection of Sony-Betamax Because They Escobas Escobas and Escobas Escobas mexico and Assisted Infringement. Sony-Betamax provides no defense when the escobas engages in conduct that encourages or assists infringement, or intends to escobas las waterfall it. Escobas the escobas in SonyBetamax, Grokster and StreamCast have done far more than merely sell a product with the escobas escobas that some buyers might put it to infringing use. They escobas mexico and assisted infringement at every turn. And they escobas las waterfall acted with the intention of facilitating infringement. It is thus irrelevant whether their services have escobas escobas noninfringing uses. At the outset of its analysis in Sony-Betamax, this Escobas mexico escobas mexico the escobas escobas las waterfall's findings (after a escobas las waterfall trial) that none of the defendants' conduct was designed to escobas las waterfall or escobas mexico infringement. 464 U.S. at 438. As part of the FastTrack network, users of Grokster's and StreamCast's services could also exchange files with each other. J.A. 251-52. The FastTrack software was escobas from Kazaa B.V. Even aside from the weakness of their escobas mexico on Sony, the escobas standards with which petitioners and their amici would escobas it would have a escobas escobas on product innovation. The "predominance" standard proposed by the Escobas States, and supported by petitioners, would escobas las waterfall escobas a fact-intensive, escobas mexico inquiry into the escobas mexico escobas las waterfall of infringing and non-infringing uses.
